Skilled Traffic Expungements Attorney Serving Clients in the Chicago Area

Traffic violations can be costly for individuals in the form of higher insurance rates, loss of driving privileges, and other penalties. In the past, minor moving violations could qualify for an expungement in Illinois. In 2010, the legislature amended the law to prohibit most moving violations from eligibility for expungement or record sealing. This was to prevent abuse by some commercial driver's license (CDL) holders who would routinely use this procedure to prevent incurring stiffer penalties for their violations. There are still some limited circumstances in which a traffic expungement can be obtained. To find out if your case qualifies, it is best to speak with an experienced criminal defense attorney.

Our Illinois Expungement Lawyers have helped individuals with expungements, record sealing and alternative remedies throughout the Chicago area for over two decades. We have extensive knowledge of the latest changes in the law, which types of cases are eligible for traffic expungements, and how to ensure a smooth and seamless process.

Which Traffic Violations Qualify for Expungements in Illinois?

In general, most moving violations, such as speeding, reckless driving, and driving while under the influence (DUI) are not eligible for expungement or sealing. There are some exceptions, however. If you fit into one of the following circumstances, you may be able to have your record expunged or sealed:

  • Reckless driving if you: (1) received court supervision, (2) were under 25 at the time of the offense, (3) are currently 25 or older now, and (4) have no other convictions on your record for DUI or reckless driving;
  • Driving an insured motor vehicle, registration suspended for no insurance, and having a false insurance card are eligible 5 years past the successful completion of court supervision.
  • Driving while your driver's license is suspended or revoked.
